Important: DocGate is a compliance aid powered by AI. Reports are indicative only and do not constitute legal, financial, or professional advice. You must not rely solely on DocGate reports to make compliance decisions.

1. Acceptance of Terms

By accessing or using DocGate ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including individuals, teams, and organisations.

2. Description of Service

DocGate is an AI-powered document compliance review tool. The Service accepts PDF documents via email or web upload, analyses them using artificial intelligence, and returns a compliance report including a score, per-rule findings, and suggested follow-up questions.

AI Disclaimer: Compliance reports are generated by AI and may contain errors, omissions, or inaccuracies. DocGate does not guarantee the correctness, completeness, or fitness for purpose of any report. Results should be treated as a guide only and verified by a qualified professional before acting upon them.

3. Eligibility

You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or your organisation. By using the Service you represent that you meet these requirements.

Plans

DocGate offers subscription plans (Starter, Team, Enterprise) billed monthly in Australian dollars (AUD) via Stripe. Plan details and pricing are available at docgate.ai/#pricing.

Usage Limits

Each plan includes a monthly audit limit. If you exceed your limit we will notify you. Overages may result in temporary suspension of the Service until the next billing period or plan upgrade.

7. Intellectual Property

DocGate and all associated software, designs, and content are owned by DocGate and protected by Australian intellectual property law. You retain ownership of all documents you submit. By submitting documents you grant DocGate a limited, non-exclusive licence to process them solely for the purpose of providing the Service.

8. Limitation of Liability

To the maximum extent permitted by Australian law, DocGate's total liability to you for any claim arising from or related to the Service is limited to the amount you paid to DocGate in the 3 months preceding the claim. DocGate is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated reports will be accurate or complete.

10. Indemnification

You agree to indemnify and hold harmless DocGate and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

12. Termination

We may suspend or terminate your access to the Service immediately if you breach these Terms, without notice or liability. Upon termination, your right to use the Service ceases. Sections 7, 8, 9, 10, and 13 survive termination.

13. Governing Law & Disputes

These Terms are governed by the laws of Queensland, Australia. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Queensland. Before commencing legal proceedings, you agree to first attempt to resolve the dispute by contacting us at hello@docgate.ai.

14. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

15. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
